Default Settings:

“Man can live and satisfy his wants only by ceaseless labor; by the ceaseless application of his faculties to natural resources. This process is the origin of property.

But it is also true that a man may live and satisfy his wants by seizing and consuming the products of the labor of others. This process is the origin of plunder.

Now since man is naturally inclined to avoid pain- and since labor is pain in itself- it follows that men will resort to plunder whenever plunder is easier than work. History shows this quite clearly. And under these conditions, neither religion nor morality can stop it.

When, then, does plunder stop? It stops when it becomes more painful and more dangerous than labor. It is evident, then, that the proper purpose of law is to use the power of its collective force to stop this fatal tendency to plunder instead of to work. All the measures of the law should protect property and punish plunder.

But, generally, the law is made by one man or one class of men. And since law cannot operate without the sanction and support of a dominating force, this force must be entrusted to those who make the laws.

This fact, combined with the fatal tendency that exists in the heart of man to satisfy his wants with the least possible effort, explains the almost universal perversion of the law. Thus it is easy to understand how law, instead of checking injustice, becomes the invincible weapon of injustice. It is easy to understand why the law is used by the legislator to destroy in varying degrees among the rest of the people, their personal independence by slavery, their liberty by oppression, and their property by plunder. This is done for the benefit of the person who makes the law, and in proportion to the power that he holds.” -Bastiat, The Law (1850), page 6-7.

Defaulting to the Constitution will make the USA wealthy; because, historically, freedom results in free trade in free markets and capital production (so-called Capitalism).

Poverty is the natural state of mankind. In the beginning of recorded history everyone was poor, including the rich, relative to today. This is because they did not have as many tools (capital) to produce as many good and services to trade for what others had produced, as compared to today.

Wealth is not how much money you have but how many goods and services you can demand with your money. If the supply of goods and services increases relative to the supply of money, then that same amount of money could be exchanged for more wealth. Thus, with the same amount money, one has become wealthier. That is how wealth is made common.

In order to increase production, one must invent/use capital (tools) to make work easier. Tools either save time doing work or increase the quality and quantity of goods and services. For example, try farming using no tools vs the horse-plough vs the tractor.

Freedom is productive. People tend to produce more when they can keep the fruit of their labor.

Under the Constitution, if you don’t hurt people and take their stuff, then you can do whatever that you want with your own property- starting with the idea that you own yourself. You are protected by due process.

Due process means that no one can deny another their life, liberty, or property without first convincing a jury of their peers in court, per the 5th Amendment. For example, common sense gun control and drug prohibition need a jury’s approval to be legally enforced against anyone.

Under the Constitution, contracts replace regulations. Mutual aid societies and charities replace welfare. In a free country, a man’s word is his bond. People make agreements with a handshake. For added security, one can use witnesses and write down the contract to be enforced by the courts. People can organize communes, associations, and charities this way.

With the free market protected by due process replacing government regulations, the legislature would only need to convene once a year to pay homage to those who fought for freedom and then go home. The court system can handle the law.

How to adopt the Constitution: Education, civil disobedience, jury nullification, and by default.

The first step is education. People need to read both their State Constitution and the US’ Constitution- notably the US Bill of Rights.

Amendment I.

Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridg- ing the freedom of speech, or of the press, or the right

of the people peaceably to assemble, and to petition the Government for a redress of grievances.

Amendment II.

A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed.

Amendment III.

No Soldier shall, in time of peace be quartered in any house, without the consent of the Owner, nor in time of war, but in a manner to be prescribed by law.

Amendment IV.

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

Amendment V.

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.

Amendment VI.

In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the State and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining wit- nesses in his favor, and to have the Assistance of Counsel for his defence.

Amendment VII.

In suits at common law, where the value in controversy shall exceed twenty dollars, the right of trial by jury shall be preserved, and no fact tried by a jury shall be otherwise re- examined in any Court of the United States, than according to the rules of the common law.

Amendment VIII.

Excessive bail shall not be required, nor excessive fines imposed, nor cruel and unusual punishments inflicted.

Amendment IX.

The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.

Amendment X.

The powers not delegated to the United States by the Con- stitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.

The second step is civil disobedience. The Civil Rights movement never ended. The government breaks the law. Disobey civilly.

The third step is jury nullification. A jury can acquit people of a crime if they deem that the law is illegal, as is the purpose of the 5th, 9th, and 14th Amendments. Due process requires the consent of the governed; hence, the power of civil disobedience.

The fourth step is by default. The USA are bankrupt. The dollar aint worth a Continental. Gold is money by default.

When we default on the debt, the government won’t be able to afford to enforce most of the laws, so we’ll default to Constitutional law when we default back to Constitutional money per Article I, Section 8, paragraphs 5 and 6 and also Article I, Section 10, paragraph 1.

Even with a plan, the future is insecure. Luckily, Americans are the most heavily armed people in the world. When we go back to our default settings, we’ll be able to provide the necessary security for a free state.

It is as if the socialists were to accuse us of not wanting persons to eat because we do not want the state to raise grain.”
